These Terms apply to your use of all Motivera services accessed via Motivera.io and any associated domains and custom domains utilized by our customers. By accessing or using our services, you signify your agreement to be bound by these Terms. If you disagree with any part of the terms, do not use our services.
This agreement exists between the company or other legal entity accepting this Agreement, and affiliates of that company or entity (referred to as “you” or “your”) and Motivera (referred to as “we”, “us”, or “our”). It governs your use of any services offered by Motivera while these terms are in effect. Our services, including the Motivera API, are collectively referred to as “the service”. The term “end users” refers to customers of our customers in this case clients and volunteers engaged with you. We do not provide warranties for the services, and this contract limits our liability. Please read these sections carefully.

We may use the email address you provided upon registration to send notifications concerning the service. If your end users contact us with questions about your service, we will refer them to you, and may disclose your email address to them.You are responsible for keeping your registration information accurate and for the security of your username and password.
Access to our services is granted on a temporary basis. We may change, withdraw, or discontinue any part of our services without notice. We are not liable if the services are unavailable at any time or for any period.
Motivera provides support exclusively via email. Motivera is a self-service system, and customers must set up their systems using our documentation. If you require assistance with technical issues or have questions about specific settings, you may contact us through the email address provided. We are not liable for actions taken based on advice received from our team.
By using our service, you consent to the processing of your information as described in our Privacy Policy. In providing our service, we act as a data processor; you remain the data controller for any personal data you process through our service. You are responsible for ensuring that the data you collect is handled in compliance with applicable laws and regulations, including obtaining necessary consents.
We utilize cookies and similar tracking technologies as outlined in our Privacy Policy.
The service may only be used in accordance with these Terms and in compliance with applicable laws and regulations.
All intellectual property in materials published by Motivera is owned by us. These rights are reserved.
You are responsible for the accuracy of information you publish via the service.
The service must not be used in any way that could damage, disable, overburden, or impair it, or interfere with any other party’s use and enjoyment of the service.
You must not send unsolicited commercial communications (‘spam’) through the service.
It’s not allowed to use the service for unauthorized purposes, including but not limited to automated data collection, without express permission from us.
You must not transmit any worms or viruses or any code of a destructive nature.
The service may not be used for activities that are against the law in your jurisdiction.
Motivera reserves the right to terminate access for users who violate these restrictions.
You may enable or use third-party services or integrations with the Motivera service. While we may provide the ability to use such services, we are not responsible for the performance of third-party services or their compliance with applicable laws and regulations.
Our liability for damages is limited to the amount you paid us for the service, up to a maximum of six months’ fees. We do not cover indirect, incidental, special, consequential, or exemplary damages.
You are responsible for maintaining adequate security and protection of data. We are not liable for any breach that results from inadequate security on your part.
We are not liable for the legality or accuracy of content uploaded by users of the service. If you publish other people’s work without their permission, you may be liable for copyright infringement.
Motivera is not responsible for any legal consequences arising from the use of the service by customers or end users. Upon notification, any content that violates copyright, constitutes defamation, or is otherwise legally improper will be removed.
The service may include or offer links to other websites or resources. Motivera has no control over such external sites and is not responsible for their availability. We do not endorse, nor are we liable for, any content, advertising, products, or other materials on or available from such sites or resources. Motivera shall not be responsible, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any content, goods, or services available on or through any such external sites or resources.
Motivera may be required to respond to requests from law enforcement agencies or other government authorities. We will comply with all such requests in accordance with applicable law.
When legally obligated, we may disclose your personal information or other data to law enforcement or government authorities. This may include situations involving investigations into illegal activities, national security matters, or other law enforcement purposes.
We will evaluate each request for user data carefully, ensuring it complies with the law. Where permitted, we will notify you of such requests unless prohibited by law or court order.
We reserve the right to modify, suspend, or discontinue the service at any time without notice. This may include access to support services, features, or functionalities. We are not liable for any modification, suspension, or discontinuation of the service or any loss of data.
Neither party shall be liable for any failure to perform its obligations where such failure results from any cause beyond our reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation.
We may suspend or terminate your account if you violate our Terms or at our discretion for any operational or legal reasons. In such cases, we will notify you with the reason for termination or suspension.
You may terminate your use of the service at any time via your account settings or by contacting us directly.
In the event of a dispute, we encourage you to contact us first to seek a resolution. If the issue cannot be resolved, we may agree to alternative dispute resolution procedures, such as mediation or arbitration, prior to seeking resolution through the courts.
In case of discrepancies between translations of these terms, the English version shall prevail.
We reserve the right to modify these Terms at any time. Changes will become effective immediately upon posting on our site unless otherwise noted.
If you disagree with the revised terms, you have the right to discontinue using our services. Continued use after the changes take effect indicates your agreement to be bound by the revised terms.
This agreement is governed by the laws of Colorado, USA.
Disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Colorado, unless otherwise required by law.

We offer a variety of services, some of which require your users’ registration or personal information. This document will refer to your users as “end users”. In order to provide our full range of services, we may collect the following types of information:
Information you provide – When you sign up for a Motivera account we ask you for personal information (such as your name, email address and an account password). We may combine the information you submit under your account with information from other Motivera services or third parties in order to provide you with a better experience and to improve the quality of our services.
Motivera cookies – When you visit Motivera, we send one or more cookies – a small file containing a string of characters – to your computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences and tracking visitor trends. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. You can control and/or delete cookies as you wish. However, some essential Motivera features and services cannot function if your cookies are disabled.
Log information – When you use Motivera services, our servers automatically record information that your browser sends whenever you use a web application. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.
User communications – When you send email or other communication to Motivera, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.
Motivera processes personal information for the purposes described above, and in addition to the above we use the information to:

Motivera processes personal information, resources submitted by end users and event registration and attendance data on our servers in Colorado.. We may process your personal information to provide our own services. In some cases, we may process personal information on behalf of and according to the instructions of a third party, such as our advertising partners. We will not use personal information of your end users that may be stored in our system to provide our own services.
If you want to completely remove your account and all associated data from our servers, you can by submitting a request to Motivera. This also erases any data of users who may have submitted their content via your account.
When you sign up for a particular service that requires registration, we ask you to provide personal information. If we intend to use this information in a manner other than the purpose for which it was collected, we will ask for your consent prior to such use.
If we propose to use personal information for any purposes other than those described in this Policy and/or in the specific service notices, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Policy and/or in the specific service notices, unless we have obtained your prior consent.
You can decline to submit personal information to any of our services, in which case Motivera may not be able to provide those services to you.
This Privacy Policy applies to Motivera services only. We do not exercise control over the sites who provide Motivera services as part of their own offering. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you. We cannot be held responsible for any wrongful handling of end users’ information by our customers.
Motivera only shares personal information with other companies or individuals outside Motivera in the following limited circumstances:
We have your consent. We require opt-in consent for the sharing of any sensitive personal information.
We may provide such information to affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures.
We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Motivera, its users or the public as required or permitted by law.
If Motivera becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we will provide notice before personal information is transferred and becomes subject to a different privacy policy.
We may share with third parties certain pieces of aggregated, non-personal information. Such information does not identify you individually.
We take appropriate security measures to protect against unauthorized access or unauthorized alteration, disclosure or destruction of data. We restrict access to personal information to Motivera employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination, if they fail to meet these obligations.
Motivera processes personal information only for the purposes for which it was collected and in accordance with this Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices ensuring that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.
When you use Motivera services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.
